Liability To Automobile Guests In Florida

In Florida, passengers can sue the driver of the vehicle that they are riding in for negligence. In this particular case, the survivors of the passengers must bring an action for wrongful death for the insurance policy limits plus any assets reachable by civil judgment belonging to the driver and owner of the vehicle.

The owner of the vehicle can be held vicariously responsible to pay for damages resulting from an accident such as this one under the “dangerous instrumentality” doctrine in Florida. Limits on the amount of a financial recovery against a vehicle owner can be found in section 324.021(9), Florida Statutes. More information is needed to know how the limits apply.
